Terms of Service

Please read these terms carefully before using endu-bot. By accessing or using our service, you agree to be bound by them.

01Acceptance of Terms

By creating an account or using the endu-bot platform (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement.

02Description of Service

endu-bot is an AI-powered endurance coaching platform that provides:

  • Personalised training plan generation for endurance sports (running, cycling, triathlon, swimming, and others)
  • An AI coaching chat assistant for sports performance guidance
  • Training calendar and periodisation tools
  • Performance tracking and analytics

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice, except where prohibited by applicable law.

03Accounts and Registration

To access most features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account credentials confidential and not share them with third parties
  • Promptly update your account information if it changes
  • Notify us immediately at support@endubot.com if you suspect unauthorised access to your account

You are responsible for all activity that occurs under your account. We will not be liable for any loss resulting from unauthorised use of your account where we are not at fault.

04Subscriptions and Payments

Plans

endu-bot offers paid subscription plans (Starter, Pro, Elite). Plan details, including features and pricing, are described on our pricing page. Prices are displayed inclusive of applicable VAT where required by EU law.

Billing

Paid subscriptions are billed on a monthly or annual basis, as chosen at checkout. By subscribing, you authorise us to charge your selected payment method for each billing period until you cancel.

Free trial

Where a free trial is offered, it begins on the date you subscribe and ends at the stated duration. After the trial, you will be charged at the standard subscription rate unless you cancel before the trial ends.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

Refunds — EU consumer right of withdrawal

If you are a consumer in the EU or EEA, you have a statutory 14-day right of withdrawal from the date of purchase. However, by requesting immediate access to the digital service, you acknowledge that you waive this right to the extent the service has already been delivered.

Outside of the statutory right of withdrawal, refunds are granted at our discretion. To request a refund, contact billing@endubot.com.

Price changes

We will provide at least 30 days' notice of any price changes. Your continued use of the paid service after the effective date constitutes acceptance of the new price.

05Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorised access to our systems, other users' accounts, or third-party systems
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Scrape, crawl, or otherwise extract data from the Service in bulk without our written permission
  • Use the Service to build a competing product or service
  • Misuse or abuse the AI coaching chat in a way that could harm yourself or others
  • Create multiple free accounts to circumvent usage limits

We reserve the right to suspend or terminate accounts that violate these rules.

06AI Disclaimer — Important

⚠️ Important: endu-bot is a technology product, not a licensed medical professional, physiotherapist, or certified coach. The training plans and advice generated are for informational and general fitness purposes only.

You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or outdated information.
  • You should consult a qualified medical professional or licensed coach before beginning any new training programme, especially if you have pre-existing health conditions, injuries, or are returning from illness.
  • You are solely responsible for your own training decisions. endu-bot does not accept liability for injury, illness, or other harm resulting from following AI-generated training advice.
  • The Service does not replace professional medical advice, diagnosis, or treatment.

If you experience pain, injury, or any unexpected symptoms during training, stop immediately and seek medical advice.

07Intellectual Property

All intellectual property rights in the Service — including software, algorithms, design, brand, and documentation — are owned by or licensed to endu-bot. Nothing in these Terms grants you any rights in the Service's intellectual property except the limited right to use the Service as described herein.

The "endu-bot" name and logo are trademarks of endu-bot. You may not use them without our prior written consent.

08Your Content

You retain ownership of any content you submit to the Service (your athlete profile, training notes, messages, etc.). By submitting content, you grant endu-bot a limited, non-exclusive, royalty-free licence to use that content solely to provide the Service to you.

We may use aggregated and anonymised data derived from usage of the Service (not linked to you personally) to improve the Service and our AI models.

You represent that you have the right to submit the content you provide and that it does not violate any third-party rights or applicable law.

09Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the terms of the Privacy Policy.

10Limitation of Liability

To the fullest extent permitted by applicable law:

  • endu-bot is provided "as is" and "as available", without any warranty of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.
  • In no event shall endu-bot be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
  • Our total aggregate liability to you for any claims under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

EU/EEA consumer note: Nothing in these Terms limits or excludes any rights you have as a consumer under mandatory applicable law, including rights under the EU Consumer Rights Directive or national consumer protection legislation. Statutory rights are not affected.

11Indemnification

You agree to indemnify and hold harmless endu-bot and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.

12Termination

You may close your account at any time by contacting us at support@endubot.com or through your account settings.

We may suspend or terminate your account if you materially breach these Terms, after providing reasonable notice where required by law. In cases of serious breach (e.g., illegal activity, fraud), we may act immediately.

On termination, your right to use the Service ceases. Sections that by their nature should survive termination (e.g., IP ownership, limitation of liability, governing law) will continue to apply.

13Consumer Rights (EU)

If you are a consumer resident in the European Union or European Economic Area, you benefit from the mandatory consumer protection laws of your country of residence. Nothing in these Terms is intended to limit or exclude those rights.

For online dispute resolution, EU consumers may use the European Commission's ODR platform: ec.europa.eu/consumers/odr.

14Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the European Union and applicable national law. Any disputes will be subject to the exclusive jurisdiction of the competent courts, without prejudice to mandatory consumer protection rules that entitle EU consumers to bring proceedings in their country of residence.

We encourage you to contact us first to resolve any dispute informally. Most issues can be resolved quickly by emailing support@endubot.com.

15Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by prominent notice on the Service at least 30 days before the changes take effect. If you continue to use the Service after that date, you accept the updated Terms.

If you do not accept the new Terms, you may close your account before the effective date.
